Paid leave in the CONSTRUCTION industry : the taking into account of seniority in the Building
Beyond the acquisition of days of statutory paid leave and holidays for fractionation and potential RTT existing in the company, certain employees of the Building may be entitled to additional days of paid leave. These days of leave are given in terms of one criterion : their seniority in one or more companies, or the Building of Public Works, calculated from the beginning of the career.
Additional rights to paid leave are earned according to the following formula :
– 2 days, after 5 years of presence in the company or 10 years in quality management or ETAM in the Building and Public Works ;
– 3 days, after 10 years of presence in the business or 20 years in quality management or ETAM in the Building and / or Public Works.
The time of presence is appreciated as at 31 march of each year. The paid leave Fund shall pay to the employee beneficiary an allowance of paid leave for the days of seniority used. For employees not attached to a fund, it is up to the employer to indemnify the employee using his days of seniority.
The workers do not receive the additional days leave in respect of seniority. But they have to increase the amount of compensation paid by the Fund for paid leave, provided the total seniority of at least 20 years in the business.
Paid leave in the CONSTRUCTION industry : the taking into account of seniority in the Public Works
In the companies of Public Works, the ETAM and executives have rights to paid leave for additional seniority under the same conditions as for the ETAM and executives of the Building.
However, unlike construction workers, workers in the Public Works have also rights to paid leave additional to the title of their seniority.
These rights, with a seniority valued at march 31 of each year, correspond to :
– 2 days for a seniority of at least 20 years in the business, whether continuous or not ;
– 4 days for a seniority of at least 25 years in the business, whether continuous or not ;
– 6 days for a seniority of at least 30 years in the business, whether continuous or not.

Paid leave in the CONSTRUCTION industry : the other specific rights to extra leave
If the length of service may permit the acquisition of additional days leave, other personal situations may also offer the employee rights to paid leave.
The first situation is that of employees with children. Depending on the age of the employee (woman or man), the rights are different. If the employee is under the age of 21, he receives 1 to 2 days ‘ additional paid leave per child to support. If the employee is aged at least 21 years of age, it can be also 1 or 2 days of paid leave per child to support, but without the total paid leave granted on the reference period does not exceed 30 working days.
The second situation is the one of the young employees. Are affected employees under the age of 21 years, having acquired over the vesting period of less than 30 days of leave. Employees can obtain leaves of absence unpaid so as to enable them to obtain a total of 30 days of rest, adding the rights to paid leave acquired over these permissions of absence.
