Energy efficiency : an appeal against the decree “tertiary”




ENERGY PERFORMANCE. A decree published on may 10, 2017 has set an ambitious goal in the area of energy renovation of the park tertiary. To the point that many players find it objectionable. Thus, the sectors of commerce, hotels and restaurants come to lodge an appeal against this text.
The sectors of commerce, hotels and restaurants (1) reported, on the 26th of June, you have lodged an appeal against the decree of 9 may 2017, said “the decree tertiary”, in relation to the obligations of improving the energy performance of tertiary buildings. As a reminder, this text provides in particular to reduce the energy consumption of these buildings by 25% by 2020.

 

According to the complainants, this text, in the state, requires the owners of commercial buildings to “develop action plan to submit to the authorities on July 1, 2017”. A schedule too tight, to the principal involved. “In addition to the annulment of the decree, the professional organizations have called for the suspension of its application, taking account of the justification of the emergency and / or serious doubt as to the legality”, explained the federations of commerce and the hotel industry in a press release. They recall, however, that they are convinced “of the vital role of the energy efficiency of buildings in their activities and, more generally, in the fight against global warming”.

The decree, which was worth $ 4.4 billion

 

The Association of mayors of France (AMF), and by the voice of Pierre Jarlier, mayor of Saint-Flour (Cantal), claims to “understand” this. “We are volunteers to make efforts in terms of energy efficiency”, he says to Batiactu. “But still it is necessary that the deadlines are realistic ! Not to mention that there is a lack of technical elements in this text so that we can implement.” The senator also expects that the objectives are set in line with the financial resources made available for supporting the local community. “We’re coming off of three consecutive years of declining allocations”, he recalls. “So, we hope that in 2018 allocations will be maintained. And we will also be attentive to the conditions of access to the support plan for communities announced by the candidate, Emmanuel Macron.”

 

Since the publication of the decree, the AMF had made known his doubts through its publication, “Mayor info” : “This decree would represent for the communities, a cost that many consider unsustainable.” The AMF also pointed out the time limit too short, it left to the actors. But also the cost of its implementation. “The cost of implementation of this reform is colossal : it could reach around 7 billion euros over three years”, can we also read. According to a government document to which Le Figaro has recently had access to, the encryption would be rather of the order of 4.4 billion euros.

Deadlines “unrealistic” to comply with

 

A few days after the publication of the text, the French building Federation (FFB) was already a postponement of its entry into force. The professional organization was disappointed, then, “the issue very late in the decree” and believed that it placed the actors involved “in a situation of great concern” with deadlines “unrealistic” to comply.
