INTERVIEW. While the Acoss has just announced that the CONSTRUCTION sector was again the most affected by illegal work, François Roux, managing director of Prism’ employment explains Batiactu why the supervision of the detachment became a priority in the building sector

Batiactu : according to the laws Savary, Macron and more recently El Khomri that reinforce the device against detachment illegal, are you able in Prism’job to prepare a balance sheet in the sector, interim BTP ?
François Roux :
It is very difficult to measure and verify in the CONSTRUCTION industry ! In the last report of the general Direction of the work published on may 30, 2016, a 10% increase in detachment was observed in 2014 compared to 2013. Despite its ignition is delayed and the difficulties observed at the national Printing press, we expect that the identification card BTP entry into force on march 22, 2017 will be rolled out gradually in all the regions by this summer, but also that the decree of application of law Work, strengthen the obligations of contractors and outsourcers, to appear.

Without any doubt, these additional resources will support the secondment in France and will participate in the recovery of the building. We emphasize that the application computer the card CONSTRUCTION is not yet adapted to the specificity of the employment agencies. With regard to the electronic data interchange (EDI), we do not yet have visibility on the implementation date.

Another positive point : the minister of Labour has informed us these days that, as of now-and-already 30 projects have been stopped in the first quarter of 2017. This is good news for companies that don’t comply with the law.

Batiactu : The European Parliament is on the point of attacking the amendment of the directive detachment, what may be the consequence of this reform on the French law ?
François Roux :
We are very vigilant that will decide the european Parliament and the Council who wish to agree on a common text. It is likely that these changes will have consequences of the changes on the French law. We don’t want them to propose initiatives that would attempt to exclude the Companies of temporary work (ETT) the scope of the directive. Let us recall the consequences : the ETT foreign could then delegate to their employees in the conditions of work and employment in their countries of origin. For the moment, nothing draws a majority among the member States for the text to be adopted in view of the block of the countries of the East.

Batiactu : what are the recommendations that you have relayed to the Presidential candidates ?
François Roux :
We have repeated in recent months that it was necessary to target controls precisely on sites with abnormally low tenders and to organise controls on all weekends. As to the right to social security, we advocate a modification of the rules relating to affiliation to the social Security scheme of the country of origin. And we are in perfect harmony with Jacques Chanut of the FFB and Patrick Liébus to Capeb. In this presidential election year, the issue of detachment is particularly political.

Temporary employment in the building sector rose 11.9% in march 2017

Batiactu : Finally, you publish this morning (Thursday) the monthly figures for the interim, where are we in the CONSTRUCTION industry?

In march 2017, on a rolling months, the temporary employment in the building sector grew by 11.9% compared to the same period of 2016. We find that there is notably more skilled workers.
