Basic knowledge of management




Any commercial or artisanal SMEs (physical or legal) must prove their basic knowledge of management to be registered in the Crossroads Bank of Enterprises (BCE). This applies to both core and complementary activities.

To apply for the registration of a commercial or craft enterprise in the ECB, the contractor must apply to a licensed contractor. In this application, he / she must demonstrate basic knowledge in management.
Management knowledge includes:

Entrepreneurial spirit and skills of the entrepreneur,
Basic knowledge in:

  • law ;
  • Accounting, financial and tax matters;
  • business management ;
  • Legislation.

Refer to the complete program in art. 6 of the Royal Decree of 21/10/1998. The company window that receives the application for ECB registration examines whether the company fulfills the conditions.

Exceptions and Exemptions

Some companies do not have to prove management knowledge:

  • The undertaking which is not a small or medium-sized enterprise within the meaning of the ECB Program Law of 10/02/1998;
  • A business that does not engage in commercial or craft activities;
  • An undertaking which carries out services in intellectual professions regulated by the framework law of 1 March 1976 (eg accountant, real estate agent or tax expert);
  • An undertaking which carries out activities with specific conditions in terms of basic management knowledge (eg transport of persons or goods);
  • The home sales business;
  • The commercial or artisan enterprise which was registered in the ECB on 1/1/1999;
  • The assignee of an existing business (for one year);
  • The surviving spouse of a deceased entrepreneur;
  • The surviving legal cohabitant of a deceased entrepreneur;
  • The surviving partner of a deceased entrepreneur who had lived with the deceased business owner for at least 6 months;
  • The children of the deceased entrepreneur, for a period of three years.

In the case of a company that meets the conditions for the person who is responsible for day-to-day management:

  • The surviving spouse of the deceased who was responsible for the day-to-day management;
  • The surviving legal cohabitant of the deceased person who was responsible for the management; Daily
  • The surviving partner of the deceased who was responsible for the day-to-day management, provided that he or she had lived together for at least 6 months.

Who must demonstrate management knowledge?

If the company is a natural person: preferably the entrepreneur himself.
When this is not possible, one of the following people can prove the knowledge base management in its place:

  • The spouse;
  • The legal cohabitant;
  • The partner with whom he / she has lived for at least 6 months;
  • An employee with an employment contract of indefinite duration;
  • An independent caregiver.

If the company is a legal person: the natural person who exercises the day-to-day management. For example :

  • In a sprl: the manager;
  • In its: the managing director;
  • In other legal persons: a director, a company executive or an employee with a contract of indefinite duration.

The company meets the requirements as long as the person who has demonstrated management knowledge remains active within the company. If this person leaves the company, the company has 6 months to regularize its situation with a company window.
How to prove knowledge in management?
Basic knowledge of management can be proven in three ways.

1. A diploma or degree

Article 7 of the Royal Decree of 21/10/1998 stipulates which securities may be taken into account. For titles that do not exist, you can consult the database-Diplo.

Indeed, it is the authorized counter of companies which is competent to determine whether the diploma or professional practice is sufficient to prove knowledge of management.

2. Sufficient professional practice

Any practice in one of the following companies, carried out during the last 15 years, can be accepted:

  • In an industrial undertaking;
  • In a commercial enterprise;
  • In a craft enterprise;
  • In an undertaking engaged in agricultural or horticultural activities.

You must prove a number of years of practice:

  • As an independent entrepreneur:
  • In main activity: 3 years, in complementary activity: 5 years.
  • As the person responsible for day-to-day management without a contract of employment:
  • In main activity: 3 years, in complementary activity: 5 years;
  • As an employee in a management position: 5 years
  • As an independent caregiver: 5 years.

Nationals of a Member State of the European Economic Area (European Union, Norway, Iceland and Liechtenstein) or Switzerland may also prove basic management knowledge with an EC certificate. This is a certificate issued by The country of origin of the person concerned, taking up professional practice and possibly education.

3. A Management Knowledge Exam

Anyone who can not claim a diploma or a sufficient professional practice may pass a Management Knowledge Examination organized by the Central Jury.
